Indemnity, Waiver and Release

Interpretation

- “Activity” means the participation in, use of, or reliance of, any products or services supplied (whether directly or indirectly) or otherwise by ViewMyCar.

  • “ViewMyCar” means AutoEd Holdings Pty Ltd trading as “ViewMyCar”

  • “I” and “me” means any individual and/or legal person that signs this form where it says “Customers Signature”

Indemnity, Wavier and Release

In agreeing to these Terms and Conditions, you agree to the following:

I acknowledge that it is a condition of utilising ViewMyCar that I do so at my own risk.

I accept all risks and hereby indemnify and release ViewMyCar, their agents, affiliates, employees, members, sponsors, promoters and any person or body directly and/or indirectly associated with ViewMyCar against all liability (including liability for negligence and the negligence of others, contract, under statute (as far as permissible), in equity or at law) including all actions, suits, claims, demands, expenses, obligations or liabilities either at law or in equity or arising under a statute and irrespective of whether the matters giving rise to those claims or otherwise are known to me or ought to be known to me as at the date of signing this form, and whether relating to my use of ViewMyCar or otherwise.

This indemnity, wavier and release continues forever and binds my heirs, successors, executors, personal representatives and assigns.

I acknowledge that utilising a service such as ViewMyCar may cause damage to my property, including my vehicle or the property of others.

I certify that I am 15 years or older and I have read this document and fully understand it.

Disclaimer

We make every effort to ensure that all the information and knowledge of vehicles given and transport requirements is accurate and kept up-to-date.

We do not guarantee the accuracy, reliability or currency of the parts, materials or information provided by us.

We give no warranty, make no representation nor give any undertaking whether express or implied, nor do we assume any liability, whether direct or indirect, or responsibility for the accuracy of information given by ViewMyCar

We accept no responsibility for and make no representations, whether express or implied, as to the accuracy or reliability in any respect of any information provided by us.

Except to the extent provided by legislation, we do not accept responsibility for the consequences of or any reliance which may be placed by any person via information provided by us.

We will not be liable to you or to any other person for any loss or damage (including direct, consequential or economic loss or damage) however caused and whether by negligence or otherwise which may result directly or indirectly following purchase or use of the vehicle.

Acknowledgement Release and Waiver

You agree not to commence any proceedings or take any action to enforce or maintain any claim against us or any of our directors, officeholders, employees and contractors and you agree to indemnify us and each of our directors, officeholders, employees and contractors against any liability, loss or costs arising from any breach by you of this agreement.

Claim means any claim, action, proceeding or entitlement whether past, present or future whether known or unknown which you or any other person has or might have under or arising out of or in any way connected to a contract or other arrangement with us.

Us/we/our means Michael James John Foley and Monica Alice Foley and any employees or future owners of AutoEd holdings Pty Ltd Trading as ViewMyCar Users of our web site are able to view the Privacy Policy and Disclaimer. www.viewmycar.com.au

Payments, Refund and Cancellation Policy

Payments for products and services must be made in full prior to us returning the keys of the inspected or worked on vehicle. 

You will be eligible for a refund on parts ordered (following the 8 hour cancellation period prescribed below) and subsequently not used for the prescribed job, this will incur a re stocking fee of 10% of the amount the parts including worth and have paid plus the shipping costs where applicable. No further administrative charges or penalties will apply regarding parts. 

You are able to cancel a booking within 8 hours leading up to the arranged service date and time. If we cannot be contacted directly by phone or email, please send an email or voice message at or before 8 hours before scheduled booking. Failure to do this will result in a .5hr (Half hour) charge as per the nominal hourly charge by ViewMyCar at the time of the cancellation.  

Complaint

If you have a complaint about anything related to your service or inspection you should first try to resolve the problem by speaking to one of our team members. However, if you feel that you cannot do this or, if your complaint or concern is about something that is not directly related to your service or inspection, you may contact us via the details provided on our website www.viewmycar.com.au

  • condition of some car Batteries inc hybrid and electrical vehicles 

  • Some Vehicle electrics and electronics

  • Transmission mechanics

  • Engine cylinder compression

  • Body water leaks or causes

  • Odometer reading correction

  • Camshaft belt, drive belt and timing belt or timing chains

  • Length of time left in some items including and not limited to ; exhaust system, clutch, dual mass flywheels

  • IF previous parts and oils have been replaced

  • Functionality of any audio-visual or entertainment system units or systems  

  • Degree of gas emissions

  • Catalytic converters

  • Additional accessories fitted 

  • LPG systems

  • Air conditioning efficiency, gas leaks or gas amounts

  • Status of livable areas of motorhomes or caravans

  • Vehicle’s computer systems

  • Further technical systems

TERMS AND CONDITIONS CTD - Products and Services 

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. ViewMyCar reserves the right at any time after receipt of your order to accept or decline your order for any reason or to supply less than the quantity you ordered of any product or service. 

Payment

Payment of product/s and services must be paid for prior to us returning the car/ car keys for the worked on vehicle. 

Credit Cards, Cash and Eftpos  

We accept the following credit cards: Visa and MasterCard payments are made through SQUARE. Please be sure to provide your exact billing address and telephone number (i.e. the address and phone number your credit card bank has on file for you).We also accept Eftpos and Cash payments. EFT payments may be made by some approved trade customers where approval has been granted in writing, in these instances, payment of any invoice is to be made in full within 14 days.

Deposits

  • A standard deposit of 25% is to be taken for PARTS with the price on the quote/invoice exceeding $500. A deposit of the parts total amount may also be requested if the item is special order or non returnable. This 25% deposit is to be added to the customers file as a credit that will come off the invoice when the job is completed. Failure to not proceed with this job, the retained 25% may be utilised for shipping and restocking fee where applicable. 

  • The franchise owner must do everything in their power to return goods with out expenses generated and refund as much if not all of the 25% deposit to aid in customer satisfaction. 

  • ALL reimbursements are to be made by the franchise owner via BSB and ACC details only for ease of reconciliation and standardised procedure.  

Warranty

All products and services from ViewMyCar are covered under a 6 month, 10,000km warranty (which ever occurs first) unless otherwise specified on the invoice. ViewMyCar reserves the right to refuse a warranty on a product or service if parties of ViewMyCar determine the fault the the product or service has been made post installation of product or service. Where a warranty is due, Products and services may be payable by ViewMyCar within reason. If a fault may be due to manufacturer fault, the customer may be required to either pay for a new product whilst the returns process is underway and or wait for the damaged product to be removed, sent back, reviewed and credited where applicable by the manufacturer or supplier.  

Incorrect Purchases

If an incorrect purchase was made, job card has been accepted and work has been made, we may agree to accept a return so long as: it is within 3 days of purchase, the product manufacturer and or supplier accepts this return. This return will come with a restocking fee, shipping costs where applicable and the cost for any labour for removing the unwanted product in addition to the original charge for initial installation labour. If the product is damaged, we may refuse to return this product.

Return Procedure

If your order complies with the above guidelines and you wish to request a refund please contact the ViewMyCar Customer Service Department by emailing us at mike@viewmycar.com.au

If a refund is applicable it will be processed within a reasonable time after contact has been made.

Refund Method

If a refund is applicable it will be processed within a reasonable timeframe after receiving the returned item. The refund will be processed through bank transfer or credit card refund depending on how you made your purchase.

Listing Errors

In the event a product or service is listed with an incorrect image, an incorrect price due to typographical error or error in pricing information received from our suppliers, ViewMyCar shall have the right to refuse or cancel any orders placed for product listed incorrectly. ViewMyCar shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and payment has been processed. If payment has been taken for the purchase and your order is canceled, ViewMyCar shall immediately issue a refund back to your account.

Website and Links 

Our website may contain links to other sites on the Internet that are owned and operated by third parties. You acknowledge that we're not responsible for the operation of or content located on or through any such site.

The legal basis for this processing is our legitimate interests, namely the proper protection of our business against risks.

2.13 In addition to the specific purposes for which we may process your personal data set out in this Section 2, we may also process any of your personal data where such processing is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

2.15 We collect information you provide when you download our app, apply or sign up for a course or purchase a product or service from us and when you provide information about yourself and individuals associated with your business as part of our identity verification process. We may collect, without limitation, the following information about you and individuals associated with your business:

  • Identification information, such as your name, email address, mailing address, phone number, photograph, birthdate and passport, driver’s licence, Medicare or other government-issued identification number;

  • Financial information, including bank account and payment card numbers;

Some of the information we collect is collected pursuant to applicable laws and regulations, including anti-money laundering laws (e.g., the Anti-Money Laundering and Counter-Terrorism Financing Act).

We also collect information you provide when you participate in contests or promotions offered by us or our partners, respond to our surveys or otherwise communicate with us.

2.14 Please do not supply any other person's personal data to us, unless we prompt you to do so.

3. Providing your personal data to others

3.1 We may disclose your personal data to any member of our group of companies (this means our subsidiaries, our ultimate holding company and all its subsidiaries) insofar as reasonably necessary for the purposes of providing you with our products and services, and on the legal bases set out in this policy.

3.2 We may disclose your personal data to our insurers and/or professional advisers insofar as reasonably necessary for the purposes of obtaining or maintaining insurance coverage, managing risks, obtaining professional advice, or the establishment, exercise or defence of legal claims, whether in court proceedings or in an administrative or out-of-court procedure.

3.3 We may disclose personal data to our suppliers or subcontractors insofar as reasonably necessary for us to provide our products and services to you.

3.4 Financial transactions relating to our website and services are or may be handled by our payment services providers, Paypal in conjunction with Commonwealth bank. We will share transaction data with our payment services providers only to the extent necessary for the purposes of processing your payments, refunding such payments and dealing with complaints and queries relating to such payments and refunds. You can find information about the payment services providers' privacy policies and practices above .3.5 In addition to the specific disclosures of personal data set out in this Section 3, we may disclose your personal data where such disclosure is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person. We may also disclose your personal data where such disclosure is necessary for the establishment, exercise or defence of legal claims, whether in court proceedings or in an administrative or out-of-court procedure.

4. International transfers of your personal data

4.1 In this section, we provide information about the circumstances in which your personal data may be transferred to countries outside of Australia. 

4.2 We have offices and facilities in Australia only and as such your personal data will remain in Australia.

4.3 The hosting facilities for our website are situated in Australia only.

4.4 You acknowledge that personal data that you submit for publication through our website or services may be available, via the internet, around the world. We cannot prevent the use (or misuse) of such personal data by others.

5. Retaining and deleting personal data 

5.1 This section sets out our data retention policies and procedure, which are designed to help ensure that we comply with our legal obligations in relation to the retention and deletion of personal data.

5.2 Personal data that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.

5.3 We will retain your personal data far a minimum of 7 years for tax purposes.

5.4 In some cases it is not possible for us to specify in advance the periods for which your personal data will be retained.

5.5 Notwithstanding the other provisions of this Section 5, we may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

6.1 We may update this policy from time to time by publishing a new version on our website.

6.2 You should check this page occasionally to ensure you are happy with any changes to this policy.

6.3 We are not required to notify you of changes to this policy by any other means other than outlined at clause 6.1 of this Privacy Policy.

7. Your rights

7.4 You have the right to have any inaccurate personal data about you rectified and, taking into account the purposes of the processing, to have any incomplete personal data about you completed.

7.5 In some circumstances you have the right to the erasure of your personal data without undue delay. Those circumstances include: the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed; you withdraw consent to consent-based processing; you object to the processing under certain rules of applicable data protection law; the processing is for direct marketing purposes; and the personal data have been unlawfully processed. However, there are exclusions of the right to erasure. The general exclusions include where processing is necessary: for exercising the right of freedom of expression and information; for compliance with a legal obligation; or for the establishment, exercise or defence of legal claims.

7.6 In some circumstances you have the right to restrict the processing of your personal data. Those circumstances are: you contest the accuracy of the personal data; processing is unlawful but you oppose erasure; we no longer need the personal data for the purposes of our processing, but you require personal data for the establishment, exercise or defence of legal claims; and you have objected to processing, pending the verification of that objection. 7.9 You have the right to object to our processing of your personal data for scientific or historical research purposes or statistical purposes on grounds relating to your particular situation, unless the processing is necessary for the performance of a task carried out for reasons of public interest.

7.10 To the extent that the legal basis for our processing of your personal data is:

(a) consent; or

(b) that the processing is necessary for the performance of a contract to which you are party or in order to take steps at your request prior to entering into a contract,

and such processing is carried out by automated means, you have the right to receive your personal data from us in a structured, commonly used and machine-readable format. However, this right does not apply where it would adversely affect the rights and freedoms of others.

7.11 If you consider that our processing of your personal information infringes data protection laws, you have a legal right to lodge a complaint with a supervisory authority responsible for data protection.

7.12 To the extent that the legal basis for our processing of your personal information is consent, you have the right to withdraw that consent at any time. Withdrawal will not affect the lawfulness of processing before the withdrawal.

7.13 You may exercise any of your rights in relation to your personal data by written notice to us at mike@viewmycar.com.au, in addition to the other methods specified in this Section 7.

8. About cookies

8.1 A cookie is a file containing an identifier (a string of letters and numbers) that is sent by a web server to a web browser and is stored by the browser. The identifier is then sent back to the server each time the browser requests a page from the server.

8.2 Cookies may be either "persistent" cookies or "session" cookies: a persistent cookie will be stored by a web browser and will remain valid until its set expiry date, unless deleted by the user before the expiry date; a session cookie, on the other hand, will expire at the end of the user session, when the web browser is closed.

8.3 Cookies do not typically contain any information that personally identifies a user, but personal information that we store about you may be linked to the information stored in and obtained from cookies.

10.3 We publish Google AdSense interest-based advertisements on our website. These are tailored by Google to reflect your interests.
